Raping girl, 15: Filipino, now serving time in jail, charged

Kota Kinabalu: A 21-year-old Filipino who is currently serving sentence for illegal entry, was charged with three counts of raping a local underaged girl.

However, no plea was taken from Mohd Khairul Nizam after he informed Sessions Court Judge Amir Shah Amir Hassan, that he has a counsel to represent him.

The charges were read to Mohd Khairul on Wednesday.

On the first count, Mohd Khairul is accused of raping the 15-year-old girl at 9pm in the middle of Sept 2024 inside a car parked near the Post Office in Tuaran.

On the second count, he allegedly raped the same girl at 1pm in the middle of Nov 2024 at a house in a village in Tuaran.

On the third count, Mohd Khairul is accused of raping the same girl at 8pm in early Dec  2024 by the roadside also in Tuaran.

The offence under Section 376 of the Penal Code carries a jail term of up to 20 years, and whipping, on conviction.

The court set Sept 4 this year and no bail was offered to Mohd Khairul.

Earlier, Deputy Public Prosecutor Bryan Francis informed the court that Mohd Khairul would be released from prison this Friday and that he objected to bail as he was an illegal immigrants.

In the same court, a 31-year-old woman pleaded guilty to committing breach of trust involving a sum of RM10,100.

However, Nurizzah Fazira Hamzah’s facts and sentencing was deferred to Sept 3 this year.

She is accused of committing the offence by breaching the trust given to her as an account clerk of the licensed moneylending company, Good Focus Mortgage Sdn Bhd, which entrusted her with the money but had used it for her own use.

The offence allegedly took place between June 13 and July 16 this year at the company premises in Papar.

Nurizzah who was not represented, was ordered to be remanded further pending the date.
