Raping girlfriend’s daughter: Man, 60, to know fate January 31

Kota Kinabalu: A 60-year-old man will know his fate on Jan 31, 2023 on a charge of raping his girlfriend’s daughter who is a disabled.

Sessions Court Judge Elsie Primus set the date for Richard @ Rich Jawi when the defence closed its case after calling three witnesses on Tuesday.

The court also set on or before Dec 19 this year for cross submissions and on or before Jan 13, 2023 for cross reply.

Richard is accused of raping the 17-year-old disabled girl at 1pm on Feb 25, 2018 at a house in Penampang.

The offence under Section 376(2)(k) of the Penal Code carries a jail term of between ten and 30 years, and whipping, on conviction.

The prosecution had called seven witnesses.

Deputy Public Prosecutor Mas Izzaty Lokman conducted the prosecution while counsel Khairuddin Noordin defended Richard whose bail was extended pending the decision.

Meanwhile, the trial of a 37-year-old man charged with causing hurt to a woman while robbing her, had been maintained which is March 8, 2023.

The date had been maintained at the moment for M. Sharif Shakhandar Benjamin who is accused of causing hurt to one Petronelia Baru, 21.

M. Sharif allegedly used a screwdriver while robbing her at 4.35am on May 28 this year at the Kedai Serbaneka Orange in Jalan Pantai, here.

He allegedly committed the offence together with an accomplice still at large.

Pending the date, M.Sharif was ordered remanded further.
