Raping minor: Man, 32, to enter defence

Kota Kinabalu: A 32-year-old man was ordered to enter his defence on a charge of raping an underaged girl.

Sessions Court Judge Noor Hafizah Mohd Salim made the order for Rezuan Hamjah, after ruling that the prosecution had established a prima facie case against Rezuan on Monday. The court set Dec 8 this year for Rezuan’s defence.

Rezuan is accused of raping the 14-year-old girl at 11pm on Dec 30, 2020 at a room of a house in Kinarut, Papar.

He was charged under Section 375(g)/376(1) of the Penal Code which provides for a jail term of up to 20 years and whipping on conviction.

The prosecution had called six witnesses during the hearing. Deputy Public Prosecutor (DPP) Dacia Jane Romanus who stood in for DPP Nur Faezah Jafry appeared for the prosecution while counsel Nabila Norsahar defended Rezuan.

In another case, a man was jailed five years and ordered to get a stroke of the cane for taking drugs repeatedly.

Mohd Syawal Faizaludin Abdul Malik admitted to the charge against him.

He was arrested on April 7 this year after testing positive for drug at the Papar police station. Mohd Syawal has several conviction records for taking drug.

After completing his jail sentence, Mohd Syawal was ordered placed under police supervision for two years.
