Raping minor: Man, 45, to enter defence

Kota Kinabalu: A 45-year-old man was ordered to enter defence on charge of raping an underaged girl.

Sessions Court Judge Noor Hafizah Mohd Salim made the order for Hamiljad Mohamad, after ruling that the prosecution had established a prima facie case against Hamiljad on Thursday.

In the ruling, Noor Hafizah said she had perused and considered all the evidences and testimonies tendered at the end of prosecution case together with submissions filed by both parties, and found that the prosecution has managed to prove a prima facie against Hamiljad.

The court set Nov 17 this year for Hamiljad’s defence.

Hamiljad is accused of raping the 12-years and seven-months-old girl at 2am on March 15, 2020 in a house of a village in Tuaran.

The offence, under Section 376(1) of the Penal Code, carries a jail term of up to 20 years, and whipping, on conviction.

The prosecution had called six witnesses during the hearing.

Meanwhile, in another court, a man was sentenced to five years’ jail and ordered to get two strokes of the cane.

Mohd Nor Nizam Samin pleaded guilty before Sessions Court Judge Ummu Khaltom Abdul Samad, to the charge against him.

He was arrested on June 9 this year after his testing positive for drug at the police station here.

Mohd Nor has several convictions records for taking drugs.

The court ordered Mohd Nor to serve the jail sentence from the date of his arrest and placed under the National Anti-Drug Agency (AADK) supervision for two years.
