
Kota Kinabalu: A 32-year-old man will know his fate on March 28 whether he will be freed or convicted on a charge of raping an underaged girl.
Sessions Court Judge Noor Hafizah Mohd Salim set the date for Rezuan Hamjah, whose defence was closed after calling several witnesses.
Rezuan is accused of raping the 14-year-old girl at 11pm on Dec 30, 2020 at a room of a house in Kinarut, Papar.
He was charged under Section 375(g)/376(1) of the Penal Code which provides for a jail term of up to 20 years and whipping, on conviction.
Rezuan was ordered to enter his defence on Sept 26, 2022 after the court ruled that the prosecution had established a prima facie case against him.
The prosecution called six witnesses during the hearing.
Deputy Public Prosecutor Nur Faezah Jafry conducted the prosecution while counsel Nabila Norsahar defended Rezuan.
Meanwhile, three illegal immigrants were jailed four months each for entering the State illegally.
Nasir Ibnu, Jurib Jamil and Muhammad Nasrin Juaini pleaded guilty separately before Sessions Court Judge Azreena Aziz.
They were arrested in the city area between Dec 15, 2022 and Jan 27 this year after failing to produce their identification documents to the police.
The court ordered them to serve the jail sentences from the date of their arrests.
After completing their jail sentence, the illegal immigrants were ordered referred to the Immigration Department for their biometric data to be recorded before deportation.
