Raping teen: Man discharged not amounting to acquittal

Kota Kinabalu: A 29-year-old man was discharged not amounting to an acquittal (DNAA) from a charge of raping an teenaged girlfriend.

Sessions Court Judge Noor Hafizah Mohd Salim gave DNAA for Muhammad Shafiq Mohd Shahfee.

The court was informed by the prosecution that the alleged victim was not interested to proceed with the case.

Muhammad was accused of raping the 15-years and three-month old girl, who was his girlfriend at the time, at 8pm on Nov 14, 2019 at a house in Papar.

The offence, under Section 376(2)(d) of the Penal Code, carries a jail term of between 10 and 30 years, and whipping, on conviction.

The trial which had been fixed was vacated and the bail posted by Muhammad to be refunded upon application by the surety. Deputy Public Prosecutor Najihah Farhana Che Awang appeared for the prosecution while counsel Datuk Norbert Chin defended Muhammad.

Meanwhile, a man was sentenced to seven years’ jail plus three strokes of the cane for repeatedly taking syabu.

Ag Latip Ag Othman pleaded guilty to the charge against him.

He was arrested on Dec 20, 2022 after his urine was tested positive for drug at the Papar police station and he has several conviction records for taking the drug. After completing his jail sentence, Ag Latip was ordered placed under police supervision for two years.
