Raping daughter: Man’s trial on August 28-29

Kota Kinabalu: A 34-year-old man, charged with raping his daughter, will go trial on Aug 28-29 this year.

Sessions Judge Noor Hafizah Mohd Salim set the date for the man whose case was brought up for mention to serve documents pertaining the case.

The court also fixed July 24 this year for pre-trial case management.

The man is accused of raping the daughter between 8 and 11pm on Aug 11, 2022 at a house in Penampang.

The offence, under Section 376(3) of the Penal Code, carries a jail term of between five and 30 years, and whipping of at least 10 strokes of the cane, on conviction.

Pending the date, the man was further remanded.

Deputy Public Prosecutor Najihah Farhan Cheh Awang appeared for the prosecution while the man was not represented.

In the same court, a 56-year-old man pleaded guilty to two counts of raping his daughter and committing physical sexual harassment against his stepdaughter.

He made the plea after the amended charges were read to him.

On first count, the man is accused of raping his 14-years and eight-months-old daughter on Nov 28, 2022 at a house in Sepanggar, near here.

The offence, under Section 376(3) of the Penal Code, carries a jail term of between eight and 30 years, and whipping, on conviction.

On the second count, he allegedly committed sexual abuse by fondling the 14-years-and six-months-old stepdaughter’s breasts at 8pm in August 2022 at the same place.

The offence, under Section 14(a) of the Sexual Offences Against Children Act 2017, provides for a jail term of up to 20 years, and whipping, on conviction.

The court set March 16 this year for pre-trial case management.
