Kota Kinabalu: A 61-year-old man was jailed for seven years by the Sessions Court here for a repeat drug consumption offence.
Judge Monica Linsua sentenced Chong Nyuk Sem after he pleaded guilty to consuming syabu.
Chong was found to have consumed the drug after his urine tested positive at a police station here at 4.50pm on June 15 this year.
He was previously convicted of drug consumption on Jan 15, 2016, and jailed for five years.
The offence was committed under Section 15(1) of the Dangerous Drugs Act (DDA) and is punishable under Section 39C(1) of the same Act, which provides for imprisonment of between five and seven years and whipping upon conviction.
The court ordered Chong to serve his sentence from the date of his arrest and placed him under police supervision for three years after his release.
During mitigation, Chong, who was unrepresented, pleaded for leniency, citing his heart condition and high blood pressure.
He also asked to return home to Peninsular Malaysia and broke down in tears while making his plea.
However, Deputy Public Prosecutor Fazriel Fardiansyah Abdul Kadir urged the court to impose an appropriate sentence, highlighting Chong’s status as a repeat offender.
