Kota Kinabalu: A 37-year-old man with two previous convictions for taking syabu was charged again at the Sessions Court here for a similar offence.
Cassey Connel, pleaded guilty before Judge Monica Linsua, but the court fixed Oct 27 for further mention pending the pathology report.
Cassey is accused of taking the dangerous drug also known as Amphetamine and Methamphetamine, on Sept 11 at 11.35am after his urine was taken at the Narcotics Criminal Investigation Division Office, Penampang District Police Headquarters.
The charge stated that he has two previous convictions under Section 15(1)(a) of the Dangerous Drugs Act 1952.
His first conviction was recorded on Aug 25, 2022 at the Magistrate’s Court here where he was sentenced to eight months’ imprisonment and placed under police supervision for two years.
For his second conviction on May 16, 2024, he was sentenced to 12 months’ imprisonment from the date of his arrest on March 28, 2024, and placed under police supervision for two years.
Cassey is now charged under Section 15(1)(a) of the Dangerous Drugs Act 1952 and punishable under Section 39C(1) of the same Act, read together with Section 38B(1) of the Act.
If convicted, he faces imprisonment of not less than five years and not more than seven years, and at least three strokes of the cane.
Section 38B(1) also provides for the accused to be placed under the supervision of an officer as provided under Section 2 of the Drug Dependants (Treatment and Rehabilitation) Act 1983 after serving sentence, for a period of not less than two years and not more than three years.
Earlier, the prosecution applied for a new mention date pending the pathology report and objected to bail being granted to the accused.
Cassey will remain in custody pending the disposal of the case.
Deputy Public Prosecutor Fazriel Fardiansyah Abdul Kadir appeared for the prosecution while the unemployed accused was unrepresented.
