
Kota Kinabalu: Five transgenders were charged in the Magistrate’s Court here on Tuesday with rioting, which incident captured in a viral video clip last month.
Aldimin Kasim, 25, Nikazwan Sharuddin, 25, Azmil Ali, 18, Steven Chin Ying Lok, 25, all undocumented, and Junidi Joi Abdullah, 26, are jointly accused of committing the offence with the intent to cause injury to Amiruddin Hasimuddin and Shah Amier Andyka Abdullah on Feb 25, this year at 12:21pm, by the roadside of Api-Api Centre, here.
Jobless Aldimin, Nikazwan, Azmil (who are both shop assistants), Chin and Junidi (both waiters) were charged under Section 147 of the Penal Code, read together with Section 34 of the same Act, which carries imprisonment sentence of up to two years’, a fine, or both, on conviction.
However, no plea was recorded from the five, who appeared before Magistrate Dzul Elmy Yunus via Zoom.
Inspector Mohamad Hamidi Mohamad Hamzah, prosecuting, objected to bail for the first four accused, citing the lack of identification documents.
He proposed bail of RM4,000 in two sureties for Junidi.
Dzul Elmy set 14 March for the five to enter their pleas and ordered Aldimin, Nikazwan, Azmil and Chin to be further remanded.
Junidi was granted bail at RM2,000 in two sureties pending the next hearing date.
In another case, a 27-year-old driver was charged with assaulting his wife.
Mohd Shafree Jafare, who appeared before Magistrate Marilyn Kelvin via zoom, is alleged to voluntarily causing hurt to the 28-year-old woman on Feb 27, this year, at 7.30 am, in a unit at Pasir Putih Apartment, Putatan.
No plea was taken from Shafree after the charge under Section 323 of the Penal Code read together with Section 326A of the same Code, was read to him.
Inspector Yusdi Basri, prosecuting, applied for a new mention date and proposed bail at RM5,000 in two sureties.
Counsel Lim Ming Zoong @ Lawrence, representing Shafree applied for a lower bail sum citing that he is married with no children and works as a driver.
Marilyn fixed March 5 for Shafree’s plea.
Shafree was offered bail at RM1,700 in two sureties pending the date.
He was not represented.
Section 323 carries a jail term of up to one year or a fine of up to RM2,000 or both, on conviction while Section 326A states that whoever causes hurt to his spouse or former spouse, a child, a disabled adult, or other family members and commits an offence under Section 323, 324, 325, 326, 334 or 335 shall be punished with imprisonment for a term of twice as long as the maximum term for which he would be liable to, on conviction, for that offence.
