Kota Kinabalu: A 26-year-old chef was jailed seven years and ordered to get two strokes of the cane for robbing a student.

Asmat Jimin pleaded guilty before Sessions Court Judge Elsie Primus, to the charge against him on Thursday.

AdvertisementHe robbed the 14-year-old boy of his handphone by using a butter knife at 12.15pm on Dec 20, 2024 at the Central Shopping Plaza in Kepayan Ridge, near here.

The offence under Section 392 of the Penal Code carries a jail term of up to 14 years, and whipping, on conviction.

During mitigation, Asmat who was not represented asked for leniency saying that it was his first offence and that he regretted his wrongdoing as well as promised to not commit any crime anymore.

Asmat also informed the court that he needed to look after his old mother.

Advertisement (adsbygoogle = window.adsbygoogle || []).push({});However, Deputy Public Prosecutor Sofia Sawayan pressed for an appropriate sentence on the grounds that Asmat had robbed the student who just finished school and also used the butter knife in order to obtain the handphone from the victim.

She added that the student had encountered trauma due to Asmat’s action.

Sofia further submitted that Asmat’s excuse that he was just kicked out from home was not acceptable to commit such crime.

She stressed that an appropriate sentence be imposed on Asmat as to give him a lesson and also to deter not only him but also similar minded individuals.

The court heard that the victim and his friends went to the said place after finishing school.

When they arrived at the emergency entrance, suddenly unidentified man approached the victim and pointed a butter knife at him, grabbed his handphone before fleeing the scene.

The victim and his friends tried to chase the man, later identified as Amat, but to no avail.

Following a police report lodged by the victim, Asmat was arrested on Dec 26, 2024 and the butter knife was recovered.

The victim also identified Asmat as the person who robbed him.
