Sexual act on sister, 14: Man gets jail and cane

Kota Kinabalu: A 30-year-old was sentenced to 10 years’ jail and ordered to be given three strokes of the cane for committing physical sexual harassment against his sister.

Sessions Court Judge Amir Shah Amir Hassan handed the sentence after the man admitted to the charge against him.

He committed the offence against the 14-year and one-month-old girl by putting his hands inside the sister’s pants for sexual purposes.

The offence took place between March 9 and 23 this year at 10pm at a house in Papar.

Read more The offence under Section 14(a) of the Sexual Offences Against Children Act 2017 provides for a jail term of up to 20 years and whipping, on conviction.

The court ordered the man to serve the jail term from the date of arrest on April 12 this year.

The man was also ordered to undergo rehabilitative counselling for two years while serving the sentence and to be put under police supervision for a year after serving the sentence.

The court heard that the incident happened while the victim was sleeping alone at the house when the man came and committed sexually abused her.

Deputy Public Prosecutor Al Hakim appeared for the prosecution while the man was not represented.
