SANDAKAN: A local failed in his bid to set aside his conviction and sentence on sexual assault against a five-year-old.
High Court Judge, Celestina Stuel Galid, dismissed the man’s appeals and affirmed the lower court’s decisions, here, recently.
The accused was also ordered to serve his imprisonment sentence effective on the same day.
The accused was charged under Section 14(a) of the Sexual Offences Against Children Act 2017 and Section 377CA Penal Code read together with Section 511 Penal Code.
He was found guilty by the Sessions Court here for touching and attempting to penetrate the victim’s genitalia using his finger, at his house here, in Sept 2018.
On the first charge, he was sentenced to seven years’ imprisonment and one stroke of whipping for touching the victim’s genitalia for sexual purpose.
On the second charge, he was sentenced to 10 years’ imprisonment and three strokes of whipping for attempting to penetrate into the victim’s genitalia using his finger.
The jail terms were ordered to run concurrently.
The accused was represented by counsel Rowiena Rasid while Deputy Public Prosecutor, Ng Juhn Tao, prosecuted.
