The Malaysian Anti-Corruption Commission (MACC) recently raided the offices of YTL Communications in Kuala Lumpur as part of its ongoing investigation into the 1BestariNet project. This probe, which also extended to a government office, is centered around allegations of false claims and other irregularities related to the RM4 billion tender awarded to YTL Communications back in 2011.
According to sources, the MACC's focus is on discrepancies in payment claims amounting to approximately RM2.7 billion. The investigation is examining the submission of false details and other potential crimes under the MACC Act 2009. The office raids led to the seizure of several documents and the identification of witnesses to aid in the inquiry.
YTL Communications’ Defense
Following the raid, YTL Power International, the parent company of YTL Communications, has defended its subsidiary. The company maintains that the 1BestariNet project, which ended on June 30, 2019, was officially certified as completed by the Ministry of Education. YTL Power stated that the project was awarded following a competitive tender process, emphasizing that their bid was both technically compliant and cost-effective.
The parent company refrained from confirming whether YTL Communications' office was specifically targeted but assured full cooperation with the MACC’s investigation. The company's share price fell by over 7% following the news of the raid, reflecting investor concerns.
Background of 1BestariNet
1BestariNet was launched in 2011 with the goal of enhancing internet connectivity and virtual learning capabilities across Malaysian schools. The project involved the implementation of high-speed internet access and the Frog Virtual Learning Environment (VLE), designed to facilitate online education.
The project, which was initially valued at RM4.07 billion, faced numerous challenges. Problems with broadband coverage, infrastructure, and service delivery, especially in rural areas, were reported and highlighted. By 2019, the Ministry of Education decided to discontinue the Frog VLE service and transitioned to other providers, citing the project's failure to meet its objectives. This decision allegedly contributed to the fallout of Maszlee Malik, who claimed he was pushed to resign as Education Minister during Tun Mahathir's second term as Prime Minister.
Political Reactions
Tan Sri Muhyiddin Yassin, who was the Education Minister when the contract was awarded, vehemently denied any wrongdoing on his part and asserted that he didn't take a single cent from the project. He explained that the decision to award the contract followed an open international tender and was approved by then-Finance Minister Dato' Seri Najib Razak. Muhyiddin emphasized that he had no involvement in the contract's execution and only learned about the MACC investigation from the media.
Recent Findings and MACC’s Statement
The MACC's investigation is partly based on recent findings from the Governance, Procurement and Finance Investigation Committee (JKSTUPKK) and the Public Accounts Committee (PAC). These reports revealed several shortcomings in the 1BestariNet project, including inadequate broadband coverage and technology deficiencies.
The MACC has indicated that there may be a need for the government to cover RM176 million in claims, with additional rental losses estimated at RM10.8 million. The investigation aims to address these issues and ensure that any irregularities are thoroughly examined.
As the investigation progresses, YTL Communications has pledged its full cooperation, and the MACC continues to conduct its inquiry with transparency and professionalism. The outcome of this investigation will be crucial in determining the final resolution of the 1BestariNet project and its associated financial claims.
