Six years' jail for using fake Power of Attorney document in land transfer

Kota Kinabalu: A 60-year-old man was sentenced to six years' imprisonment by the Sessions Court here for using a fake Power of Attorney document to transfer land that did not belong to him.

Judge Monica Linsua handed down the sentence on Lim Chen Lian after ruling that the prosecution had established its case beyond reasonable doubt at the end of a trial in which six prosecution witnesses and one defence witness testified.

Lim was convicted under Section 471 of the Penal Code, punishable under Section 467 of the same Code, for using the forged document dated Feb 25, 2022, at a legal firm in Sinsuran.

Deputy Public Prosecutor Fazriel Fardiansyah Abdul Kadir urged the court to impose a deterrent sentence highlighting the high degree of culpability and planning involved in document forgery, despite a plea for leniency from the unrepresented accused.

Ordering Lim to serve his prison term from the date of conviction, the court rejected his application for a stay of execution.
