
KK Supermart & Superstore Sdn Bhd, a prominent convenience store chain, has taken legal action against its local supplier, Xin Jian Chang Sdn Bhd, regarding the controversial socks that bore the word "Allah." The lawsuit, filed today at the High Court in Shah Alam, seeks redress for alleged business interference and financial losses incurred by KK Supermart.
Confirming the legal proceedings, KK Supermart's lawyer, Datuk David Gurupatham, affirmed that his client initiated the civil lawsuit. The lawsuit targets Xin Jian Chang Sdn Bhd and its director, Soh Chin Huat, alleging unlawful interference with KK Supermart's business operations. KK Supermart seeks a court declaration affirming the supplier's wrongful conduct and demands indemnification for resultant losses. Additionally, the lawsuit aims to prevent further business disruption by securing court orders against Xin Jian Chang and its director.
Among the damages claimed, KK Supermart seeks compensation for lost profits, estimated at RM1.5 million per week, attributed to the controversy. The convenience store chain also seeks restitution for damage to its brand reputation and goodwill in the market, totaling RM10.5 million. Furthermore, KK Supermart pursues reparation for losses incurred due to the aborted proposed stock exchange listing, amounting to RM20.3 million, along with additional damages to be assessed by the court.
The legal action follows an apology issued by Xin Jian Chang on March 19, expressing regret for any offense caused by the socks bearing religious connotations. The company denied intentional involvement in procuring socks with the word "Allah" and asserted its efforts to caution Chinese suppliers against producing potentially offensive products.
Xin Jian Chang attributed the incident to a mistake by its China-based supplier, Mu Mian Qing Hosiery Co Ltd, which inadvertently included five pairs of controversial socks in a larger order of 18,800 pairs. Seeking recourse, Xin Jian Chang indicated its intention to pursue legal avenues against the negligent supplier.
The lawsuit underscores KK Supermart's resolve to address the fallout from the sock controversy through legal channels. As the legal proceedings unfold, stakeholders await the court's assessment of damages and potential repercussions for both the convenience store chain and its supplier.
