Close kin of mine just purchased a condominium through the bank's auction unit. He was overjoyed that he had finally gotten his house. After paying all his bank and lawyer bills, he received a surprise.
When he went to see his ideal house, he was surprised to find a man and his family living there (unauthorized). Despite giving proof that he is the new owner of the residence and a month to vacate the unit, these unauthorized occupants refuse to budge. This tenant was unable to show proof of a tenancy agreement with the former owner.

JMB: Joint Management Body.
- There is a building management firm in that condo; when questioned, they say they are unsure, and anybody can enter through the condo security guard. What I don't get is how an unauthorized occupant may park his car in the condo owner's parking space and enter and exit the apartment using an access card. A police report was filed and handed over to management, but there was no outcome from the management.
Is there some kind of agreement between the security guard and the management personnel, as this unauthorized occupant can roam freely into the condo?
This signals a significant security breach.
Now the management is requesting that my close kin pay the maintenance fee and water bill, which totals almost RM10000. What steps has management taken to reclaim the money from the previous owner or unauthorized occupant?
Why should the new owner pay the unpaid costs since management failed to monitor utility usage as well as illegal movement in and out of the flat?
Numerous emails and phone calls to management were ignored. My lawyer contacted the management but did not receive any response. Requesting a meeting with the chairman was ignored.
Are there any rules that exempt management from fulfilling their responsibilities when the owners pay them for their services?
COB: Commissioner of Buildings.
Complaint to COB: They do not acknowledge receipt of the complaint. There is no indication as to what action or solution they are pursuing. It is futile to have a COB that does not carry out its responsibilities diligently and in compliance with strata legislation.
Who is monitoring the uptime related to the complaints received by this department? Which ministry monitors COB's monthly complaints and actions? Is it necessary to channel all compliance through SISPAA (Sistem Pengurusan Aduan Awam JPA)?
I have firsthand experience dealing with COB; it took them two years to respond to my questions about my unit management. They only responded when I promised to bring this up with the Strata Management Tribunal. Anyway, they didn't respond to any of my questions, instead skirting the issue.
