
Kota Kinabalu: A 41-year-old man was sentenced to a total of seven years and 10 months in prison and ordered given 10 strokes of the cane for having syabu and cannabis.
Sessions Court Judge Hurman Hussain meted out the sentence to Rozan Roslan Junior who admitted to two charges against him.
On the first count, Rozan was jailed seven years plus whipping for having 36.25gm of syabu at 3.30pm on Apr 29, 0224 at a house in Inanam Laut, Kalansanan, here.
The offence under Section 12(2) of the Dangerous Drugs Act (DDA) and punishable under Section 39A(2) of the DDA provides for jail between five years and life imprisonment, and whipping of at least 10 strokes of the cane, on conviction.
On the second count, he was sent to prison for another 10 months for having 0.43gm of cannabis at the same place and time.
The offence, under Section 6 of the DDA, carries a fine of up to RM20,000, or a jail term of up to five years, or both, on conviction.
The court ordered Rozan to serve the jail sentence concurrently from the date of his arrest.
In mitigation, Rozan who was not represented, asked for leniency.
However, Deputy Public Prosecutor Fazriel Fradiansyah Abdul Kadir who conducted the prosecution, urged the court to impose a heavy sentence as the offence was serious and rampant.
