
Kota Kinabalu: A 32-year-old man was tentatively charged at the Magistrate’s Court here with trafficking 67.30gm of syabu.
No plea was recorded from Md Aliff Kassem when the charge was read before Magistrate Marilyn Kelvin.
Aliff is accused of committing the offence on Sept 29, at 9.45pm, at the pedestrian area near the Anjung Senja roundabout here.
The charge, framed under Section 39B(1)(a) of the Dangerous Drugs Act (DDA) 1952, carries the mandatory death penalty or life imprisonment, along with a minimum of 15 strokes of the cane, upon conviction.
The court set Dec 3 for mention, pending the chemist’s report.
Aliff was ordered to remain in custody as the offence is non-bailable.
In another case, nine people were penalised for committing drugs offences.
Three of them Nor Azmi Udin, Losius Dawang, Supanih Molyadi pleaded guilty to having syabu weighing 0.03gm, 0.19gm and 0.05gm respectively here.
Losius was sentenced to nine months jail, Azmi was jailed eight months while Supanih was fined RM2,800 or nine months jail.
Having syabu framed under Section 12 (2) of the Dangerous Drug Act 1952, provides for a fine of up to RM100,000 or up to five years jail or both on conviction.
Meanwhile, the other six - Md Safri Batling, Zari Nur, Abdul Rahil, Mogong Junul, Khairol Adzman and Gizin Gilok pleaded guilty to taking syabu.
Abdul and Khairol were handed eight months jail each, Zanri, Safri and Mogong received seven months jail each while Gizin was fined RM2,000 or seven months jail.
Taking syabu as framed under Section 15(1) of the Dangerous Drug Act provides for a fine of up to RM5,000 or up to two years jail on conviction.
