
Kota Kinabalu: A34-year-old Filipino, charged with trafficking 105.27gm of syabu, was ordered to enter his defence.
High Court Judge Leonard David Shim made the order on Sisal Hasan on Tuesday.
The court set Feb 24 for Sisal’s defence.
Sisal was accused of committing the offence at 5.10pm on April 11, 2019 by the roadside of Lorong Bandar Putra 1C, Manggatal.
He claimed trial to the charge under Section 39B(1)(a) of the Dangerous Drugs Act 1952, on Aug 5, 2021.
The charge is punishable under Section 39B (2) of the same Act which carries the death sentence or life imprisonment and whipping not less than 15 strokes if not sentenced to death, on conviction.
The prosecution had called three witnesses to testify at the prosecution’s stage.
Deputy Public Prosecutor (DPP) Mohammed Ali @ Rocky Imran prosecuted. Sisal was represented by counsel Mark Sitiwin.
Meanwhile, in a Magistrate’s Court, an unemployed man was sentenced to 20 months’ jail for stealing a drone worth RM2,200.
Ahmad Aiddilizan pleaded guilty before Magistrate Jessica Ombou Kakayun to stealing the drone belonging to one Md Shukri Hashim at 9.35pm on Jan 14, this year at Restoran Selera Kita, Taman Vista Minintod, Bundusan Penampang.
The court was informed by the prosecution, prior to the incident Ahmad and Shukri met at the restaurant to discuss on the selling price of the drone.
Ahmad agreed to buy it from Shukri for RM2050 and told the latter to take the money from his (Ahmad’s) car and at the same time Ahmad took the bag containing the drone on the table.
Shukri, who suspected Ahmad’s actions, followed him to the car but Ahmad fled.
Ahmad was later arrested by police on Jan 25 at Gayang Tuaran following a report lodged by the complainant.
He was charged under Section 379 of the Penal Code which carries a jail term of up to seven years or fine on conviction.
Unrepresented, Ahmad requested leniency while Inspector Albert Basiri, prosecuting, applied for a deterrent sentence.
