Two China nationals fined RM30,000 each over uncertified mobile phones

Kota Kinabalu: Two brothers from China were fined RM30,000 each in default of nine months' imprisonment by separate Sessions Courts here for possessing uncertified mobile phones with intent to sell.

Yong Weilong, 25, and his brother Yang Junjie pleaded guilty before Judge Zaini Fishir and Judge Marlina Ibrahim respectively after being caught at the Kota Kinabalu International Airport departure gate on 3 August with 197 uncertified iPhones.

The duo were charged under Regulation 16(1)(d) of the Communications and Multimedia (Technical Standards) Regulations 2000, an offence punishable by a fine of up to RM300,000, up to three years' imprisonment, or both.

Defense counsel Mohd Al Hafidz Mohd Lokman pleaded for leniency on grounds of remorse as first-time offenders, while Deputy Public Prosecutors Mohd Fadzri Azham Zainudin and DK Alya Afiqah PG Johari urged the court to impose a deterrent sentence to maintain communication network standards.

The court heard that Commercial Crime Investigation Department officers intercepted the two businessmen prior to their flight to Kuala Lumpur after they failed to provide a valid explanation for carrying the large shipment of mobile devices.
