
During the ongoing proceedings at the High Court, an asset recovery specialist, Angela Barkhouse, stated that there was a lack of evidence to support the claim that former Prime Minister Najib Razak had "returned" a purported US$120 million from SRC International to Tanore Finance Corporation, a Singapore-registered firm.
Barkhouse clarified that she had not come across any documentary evidence indicating that the US$120 million was indeed returned to Tanore in 2013. When questioned by Najib's lawyer, Harvinderjit Singh, about the possibility of the money being returned through redemption as part of a larger sum of US$620 million, Barkhouse maintained that she had not seen evidence to support this assertion, emphasizing that it was a separate issue.
SRC International has filed a lawsuit against Najib and its former CEO, Nik Faisal Ariff Kamil, alleging breach of trust and duty, wrongful receipt of company property, and conspiracy to convert company property for personal use. While initially six former directors were named as co-defendants, they were later dropped from the lawsuit by SRC International. However, Najib has named them as third parties in the case.
In addition to seeking legal redress, SRC International aims to recover the US$120 million allegedly transferred to Tanore, with Najib being asked to return the funds, and Nik Faisal to repay US$2 million.
During the proceedings, Barkhouse also mentioned her awareness of Tan Kim Loong's association with Tanore, stating that he was an aide to Low Taek Jho, commonly known as Jho Low, as indicated in a lawsuit filed by the US Department of Justice (DoJ). However, Barkhouse clarified that she was not directly involved in the DoJ case.
The hearing is set to continue before Justice Ahmad Fairuz in the coming days, as the court seeks to examine the evidence and arguments presented by both parties involved in the case.
This development sheds light on the complexity of the legal proceedings surrounding the alleged misappropriation of funds from SRC International, highlighting the importance of thorough investigation and presentation of evidence in the pursuit of justice.
