A Malaysian woman claims her employer withheld her salary to prevent her leaving before completing her notice period, raising legal concerns.

A Malaysian woman recently alleged that her employer withheld her salary as a means of ensuring she would not “run away” from completing her notice period.

“I want to ask, can my employer do this?” she captioned in a viral Threads post.

Replying to a commenter, she confirmed that she had not resigned but had been switched to a part-time position at her workplace.

The company was allegedly supposed to pay her salary for April until the end of her term.

“They are holding my salary because they’re afraid I might leave,” she claimed.

According to her post, she had completed her notice period in her previous position, but the company allegedly planned to withhold her salary, which is usually paid before the seventh of each month.

A screenshot she attached showed that the company allegedly intended to withhold her pay until May 11, which is her last day before taking on her new role as a part-time staff member.

In the end, the woman managed to receive her salary after her employer allegedly caught wind of her viral post.

Under Malaysian law, it is generally unlawful for employers to withhold employees’ salaries after they have tendered their resignation, as outlined in the Employment Act 1955.

However, an exception may arise in cases involving tax clearance, where employers are required to wait for a letter issued by the Inland Revenue Board (LHDN).

Netizens urged the woman to report the matter to the Labour Department Malaysia, citing potentially unlawful labour practices.
