Kota Kinabalu: A 40-year-old undocumented man was tentatively charged in the Magistrate’s Court here with trafficking 53.23gm of syabu.

Labourer Julnakib Abdullah, who was brought before Magistrate Marilyn Kelvin allegedly committed the offence on Oct 2, this year, at 6.30pm, at the bridge area in Kg Sembulan here.

However, no plea was recorded from Julnakib.

The prosecution in applying for a mention date objected to bail as the charge against the accused has no provision for bail.

The court fixed Nov 27 for mention pending the chemist’s report and ordered the accused to be remanded further.

Meanwhile, a 22-year-old man was jailed seven months’ jail for attempted burglary.

Mohammad Shahyassin pleaded guilty before Magistrate Wan Farrah Farriza Wan Ghazali for trying to break into the surau Marhabah Taman Muhibbah, in

Penampang on July 27, this year, at 10.15pm.

Mohammad committed the offence by prising open the window of the premises with the intention to steal.

He was charged under Section 457/511 of the Penal Code.

Bharathan told the court that Mohammad was caught red-handed by a resident, who subsequently handed him over to the police.

Investigations revealed that prior to the incident, Mohammad had been caught twice for breaking into the premises and stealing the donation box inside.

In another case, a Filipina restaurant worker was jailed two months for stealing RM800 from her workplace.

Undocumented Aliza Abdul Sani pleaded guilty before Magistrate Marilyn to committing the offence on Sep 14, 2024, at 6.02pm, at Sitti Azura restaurant in Warisan Square here.

The facts of the case presented by prosecuting officer, Inspector Alia Nuurlysa Adnan, Aliza was arrested by police on Sep 19, at 11.25pm, in a rented room here, following a report lodged.

The charge under Section 381 of the Penal Code carries a jail term of up to seven years or fine, on conviction.

Unrepresented, Aliza requested leniency.

Alia applied for a deterrent sentence and informed the court that Aliza was earlier sentenced to four months jail by the Sessions Court for illegal entry under Section

6(1)(c) of the Immigration Act.

Marilyn ordered Aliza to serve the sentence from the date of arrest and granted the prosecution’s application for her to be referred to the Immigration Department thereafter for further action
