
Kota Kinabalu: An unemployed man was charged in the Magistrate’s Court, here, Tuesday with trafficking in 7,174gm of syabu.
Kong Jian Wei, 37, was accused of committing the offence at 2.45pm on Jan 26, this year at a roadside of Lorong Ranggung Batek, Likas.
However, no plea was recorded from Kong, who appeared before Magistrate Lovely Natasha Charles, via video conferencing.
The charge under Section 39B(1)(a) of the Dangerous Drugs Act 1952, carries a punishment with either the death penalty or life in prison and whipping with a minimum of 15 strokes.
The prosecution applied for a new mention date while waiting for the chemist’s report and objected bail as the charge has no provision for bail.
Lovely set April 7 for mention and ordered Kong to be further remanded.
Kong was not represented.
Meanwhile, a shop assistant was fined RM700 or two months jail for committing affray in public.
Gabriel Yap, 22, changed his plea to guilty to having a fight with another accused Sherillin Adrino, 25, who was jointly charged with him to the offence at 3am on Nov 16, 2021 in front of a cafe in Penampang.
The duo’s case came up for mention on Tuesday in which Yap pleaded guilty while Sherillin maintained her innocent and would have her case be tried on May 5.
Earlier, Inspector Kelvan Elson Maik, prosecuting, in tendering the facts of the case for Yap, told the court that the incident occurred while both Yap and the other accused were intoxicated and that they met to settle their problem regarding a car issue before a brawl ensued between them.
Yap, who was not represented, requested a lenient sentence while Kelvan applied for an adequate sentence.
The charge under Section 160 of the Penal Code carries a jail term of up to six months or fine of up to RM1,000 or both on conviction.
