
Kota Kinabalu: A recycle items collector, who trespassed into a house in Penampang, last month was fined RM1,000 or a month’s jail on Thursday.
Cassey Connel Joseph, 32, pleaded guilty before Magistrate Jessica Ombou Kakayun to committing the offence at Kg Kibabaig at 3pm on Jan 21.
Cassey was charged under Section 447 of the Penal Code which carries a jail term of up to six months or fine of up to RM3,000 or both, on conviction.
Inspector Kelvan Elson Maik told the court that a complainant lodged a police report claiming that the unoccupied house of 20 years belonging to a relative which was under his care was broken into and all the electrical wiring in the house was stolen.
The court heard that two witnesses saw the incident and had taken a photo of Cassey and an accomplice, who is still at large, at the said house.
Duty counsel Lim Ming Zoong @ Lawrence, representing Cassey, requested for a lenient sentence on the ground that he is married with four children and was remanded for seven days.
Kelvan applied for an adequate sentence.
In another case, Cassey also pleaded guilty to a charge of disposing of stolen electrical cables.
He allegedly committed the crime at 2.20pm on April 18, 2021 at a scrap metal factory here.
The charge under Section 414 of the Penal Code carries a jail term of up to seven years or fine or both, on conviction.
His case came up for review for his arrest warrant on Thursday, where he informed the court that he could not be come to court during the previous mention of his case as one of his children was admitted to the hospital.
Jessica vacated the arrest warrant and adjourned the case to March 16 for sentencing.
Cassey is also facing another charge of taking drugs but no plea was recorded from him pending the chemist’s report.
The court fixed March 16 for an e-review of the case and offered Cassey bail at RM1,000 in two sureties pending the date.
Meanwhile, two men were fined RM1,700 or four months jail each for taking Amphetamine and Syabu.
Ahmad Fazirul, 27, and Dafi Hassan, 33, admitted to committing the offence on Jan 18, 2020 and Jan 18, 2021 here, respectively.
Taking drugs under Section 15(1) of the Dangerous Drugs Act provides for a fine of up to RM5,000 or up to two years jail, on conviction.
The court also ordered them to be placed under police supervision and National Anti-Drugs Agency (NADA) for two years.
