RM1,500 fine for illegal gambling

Kota Kinabalu: The Magistrate’s Court here Thursday ordered a man to pay RM1,500 or two months jail for engaging in illegal gambling.

Irv Vialley Duin, 25, pleaded guilty before Magistrate Jessica Ombou Kakayun to committing the offence at 10.30am on Aug 11, 2020 in a premises at Check Point, Beverly Square in Penampang.

The court heard from the prosecution that the police went to the premises following public information on gambling activity and arrested Irv, who was caught committing the offence and seized a handphone as well as RM70 cash from him.

Irv was charged under Section 7(2) of the Common Gaming House Act 1953 which provides for a fine of up RM5,000 or up to six months jail or both on conviction.

Unrepresented, Irv requested a lower fine as he has financial problems and bears siblings who are still in school.

Meanwhile, two men were penalised for fraudulently having money in their respective bank accounts.

Sufian Imat, 32, was fined RM100 or one day jail for having RM5,000 belonging to one Lerina Daisman in his bank account at Inanam at 3.56pm on Oct 2, 2020.

Mohd Sahrriilazmy Sani, 22, was fined RM100 or three weeks jail by Magistrate Lovely Natasha Charles for having RM1,280 belonging to one Georgy Sumbing in his bank account at 10.36am on Oct 10, 2020 in Sepanggar.

Both Sufian and Sahrrillazmy failed to give a satisfactory explanation on how they obtained the money.

They had committed an offence under Section 22A (1) of the Minor Offences Ordinance which provides for a fine of up to RM100 or up to three months jail or both on conviction.

Both requested leniency.
