DJ, another fined for flouting Covid SOPs

Kota Kinabalu: An entertainment outlet music deejay was fined RM2,500 or three months jail on Monday for operating the premises beyond the permitted time.

Alnibar, 35, pleaded guilty before Magistrate Lovely Natasha Charles to committing the offence while as a deejay at the Golden City cafe, Pintas Avenue, Penampang at 1.30am on Feb 12.

Inspector Kelvan Elson Maik, prosecuting, told the court that a police team conducting an Ops Noda (entertainment outlet) went to the location and found the door closed and heard the music from inside the premises.

Police knocked on the door several times but it was not opened, the court heard.

The team then picked the lock on the door of the premises after receiving no response even after the police had continued knocking for 10 minutes, said Kelvan.

The court heard that the police inspected the premises and found a deejay, later identified as Alnibar in a deejay room.

Alnibar was charged under Section 4(1) of the Public Entertainment Ordinance 1958 which is punishable under Section 11 of the same Ordinance that provides for a fine of up to RM5,000 or up to one year or both on conviction.

Unrepresented Alnibar, requested a lenient sentence.

Kelvan applied for an adequate sentence.

Meanwhile, a woman was also charged with a similar offence.

Nurhuda Nasir was accused of operating the said premises beyond the permitted time while acting as caretaker of the outlet at the same time and place.

However, no plea was taken from Nurhuda, who appeared via video conferencing before Magistrate Jessica Ombou Kakayun.

Kelvan in applying for another mention date proposed no bail as Nurhuda has no valid identification document.

Jessica set March 29 for Nurhuda’s plea in open court and ordered her to be remanded further.

In another case, a 34-year-old man in possession of syabu was fined RM2,700 or nine months jail.

Florin Fedilis admitted to having 0.03gm of syabu at 4.30pm on Dec 6, 2021 in a house at Kg Potuki Penampang.

He was charged under Section 12 (2) of the Dangerous Drug Act 1952, which provides for a fine of up to RM100,000 or up to five years jail or both on conviction.
