Man ordered to enter defence for raping 16-year-old

Kota Kinabalu: A 28-year-old man was ordered to enter his defence on April 25 and 26 year on a charge of raping an underaged girl.

Sessions Court Judge Elsie Primus made the order against Shahreyan Shah Lagayu after ruling that the prosecution had established a prima facie case against Shahreyan, Monday.

Shahreyan is accused of raping the 16-year-old girl inside a car at the Likas Sport Complex, here, between 10pm and 11.59pm on Nov 10, 2019.

The offence under Section 376(1) of the Penal Code carries a jail term of up to 20 years, and whipping, on conviction.

Meanwhile, a 25-year-old man who took syabu for the third time, was sentenced to five years’ jail and ordered given a stroke of the cane.

Azahir Jamlu pleaded guilty.

He took the drugs at 9.30am on May 28, 2021 after his urine was tested positive at the Kota Belud police station.

Azahir has two previous convictions for taking drugs.

He was charged under Section 15 (1) (a) of the Dangerous Drugs Act and punishable under Section 39C(1)(a) of the same Act which provides a jail term of between five and seven years, and whipping, on conviction.

During mitigation, Azahir asked for leniency and the sentence to be served from the date of his arrest.

However, the prosecution urged the court to impose an adequate sentence as Azahir had repeated the offence.

The court ordered Azahir to serve the jail sentence from the date of his arrest and after completing his jail sentence, he was ordered placed under police supervision for three years.
