
Kota Kinabalu: A 29-year-old man with a unique name was jailed five years and ordered to get a stroke of the cane for taking syabu repeatedly.
Mohd Happy Kasehan pleaded guilty before Sessions Court Judge Elsie Primus to the charge against him.
Happy was found taking the drug at 7.10am on Jan 22 this year at the police station after testing positive.
He had two previous convictions.
The offence under Section 15(1)(a) of the Dangerous Drugs Act 1952 and read together under Section 39C (1) of the same Act provides for a jail term of between five and seven years, and whipping, on conviction. The court ordered Happy to serve the jail sentence from the date of his arrest and placed under police supervision for three years.
During mitigation, Happy, who was not represented, asked for leniency and that the sentence to be served from the date of his arrest. Happy informed the court that he is still single and prior to his arrest, he was self-employed in making furniture.
Deputy Public Prosecutor Tham Pou Jin urged the court to impose an appropriate sentence to give a warning not only to Happy but the public at large.
She submitted that Happy was a habitual offender with past convictions.
