RM3,000 fine for hurting wife

Kota Kinabalu: A 57-year-old sub-contractor was slapped with a fine of RM3,000 or six months’ jail on Monday for assaulting his wife.

Loo Yew Fai pleaded guilty before Magistrate Stephanie Sherron Abbie to causing hurt to his 45-year-old wife at 12.15am on Jan 23 this year in a house at Taman Millennium Height, Bundusan, Penampang.

The court was informed by the prosecution that an argument ensued between the couple when the wife wanted to scold their son for playing computer games till midnight.

Loo turned on his wife and hit her causing bruises on both her arms, wounds on the cheek, ear and mouth and swollen toes, said the prosecution, adding that the wife then lodged a police report.

Loo was charged under Section 323 of the Penal Code read together with Section 326A of the same Code.

Section 323 carries a jail term of up to one year or a fine of up to RM2,000, or both, on conviction while Section 326A states that whoever causes hurt to his spouse or former spouse, a child, a disabled adult, or other family members and commits an offence under Section 323, 324, 325, 326, 334 or 335 shall be punished with imprisonment for a term of twice as long as the maximum term for which he would be liable to on conviction for that offence.

Counsel Amli Nohin, representing Loo, applied for a fine on the grounds that he was remorseful for his action. He promised not to repeat it and has been trying to repair the marriage. It was also his first offence.

Amli told the court that it was a domestic dispute whereby the couple had been consuming wine that night and both were fairly intoxicated when the fight occurred and that the wife has left the house and their three children with him.

The prosecution applied for an adequate sentence.

In another case, 11 people were penalised for committing drug-related offences.

Six of them Law Siong Tien, Amir Nazir, Awang Baharudin, Hisamudin Baharuding, Al Putra Yusup, Azman Suli who admitted to taking drugs at separate locations here and in Penampang in February.

Law, Amir and Awang were handed 10 months’ jail while the rest were fined RM2,800 or six months’ jail each.

They had committed an offence under Section 15(1) of the Dangerous Drug Act provides for a fine of up to RM5,000 or up to two years jail on conviction.

The other five, Romi Stephen, Fatiha Subaha, Rahmat Lamit, Najilai Josep and Isaiah Emanuel pleaded guilty to having syabu as framed under Section 12 (2) of the Dangerous Drugs Act 1952, which provides for a fine of up to RM100,000 or up to five years’ jail, or both, on conviction.

Romi and Fatiha were each jailed 16 months, Najilai was handed eight months Rahmat was fined RM4,800 or 12 months, while Isaiah was fined RM2,900 or seven months’ jail. Inspector Suzie @ Stephanie Kupit prosecuted.
