The District Bar Association Chandigarh (DBA) has decided to extend their protest against the newly notified Tenancy Act for Chandigarh.

Sandeep Gujjar, vice-president, District Bar Association (DBA), Chandigarh, said the strike would continue till May 20.

The DBA, in its General House meeting held on May 8, had decided to abstain from work against the newly notified Tenancy Act for Chandigarh.

Gujjar said it had further been decided that no matter would be entertained during the extended strike period.

He said General House Meeting would be held on May 20 at 11 am in the Bar Room to decide the future course of action.

A five-member committee has been constituted to file an appropriate writ petition with regard to the Tenancy Act.

Members of the committee include NK Nanda, Yogesh Mittal, Vinod Choda, Pawan Sharma and Vinod Verma.

Gujjar said that under the East Punjab Urban Rent Act, rent petitions were filed before the Rent Controller, i.e., the Judicial Magistrate. Under the Assam Tenancy Act, implemented in Chandigarh, rent petitions would be filed before the Executive Magistrate (Circle Officer). Advocates would have to visit their offices from the court complex as per the convenience of the officers.

Judicial Magistrates are law graduates, whereas Executive Magistrates may not necessarily be law graduates. They said that “without the application of a judicial mind”, the legality of rent petitions could not be decided in a fair manner.
