
Kota Kinabalu: The Magistrate’s Court here Tuesday sentenced a workshop worker to 10 months in jail for assaulting his colleague, four months ago.
Sylvester Tumik, a 28-year-old pleaded guilty before Magistrate Stephanie Sherron Abbie to voluntarily causing hurt to one Jounes Junior Anthony at 2am on June 5, this year at the quarters of Bintang Ramai Workshop, at Towering, Penampang.
The facts of the case presented by the prosecution stated that on the said day, Sylvester punched the victim’s face causing injuries to his face.
During the incident, Sylvester was under the influence of syabu and hallucination causing him to lose judgment and failed to control himself and attacked his colleague, the court heard.
Sylvester requested leniency while the prosecution applied for a deterrent sentence.
Sylvester had committed an offence under Section 323 of the Penal Code which carries a jail term of up to one year or a fine of up to RM2,000 or both, on conviction.
He was ordered to serve the sentence from the date of his arrest.
In another case, a 20-year-old man who fraudulently deposited RM7,000 into his bank was fined RM100 or a day’s jail.
Md Fazril Ramlan admitted to having the money belonging to one Margaret Medina in his CIMB Bank account here at 11.25am on May 27, this year.
The charge stated that Fazril failed to give a satisfactory explanation on how he obtained the money at 10am on Dec 22, 2020.
The offence under Section 22A (1) of the Minor Offences Ordinance, provides a fine of up to RM100 or up to three months jail or both, on conviction.
