
Kota Kinabalu: A 36-year-old pork seller was jailed 12 months and fined RM2,000 or another six months, Friday, for assaulting his wife last week.
Andy Faziero Albert pleaded guilty before Magistrate Stephanie Sherron Abbie to committing the offence to the 27-year-old housewife at 11pm on June 15 at the parking lot of a rented house at Kg Kobusak, Penampang.
According to the prosecution, prior to the incident, the couple were involved in a heated argument.
Andy then lost control and hit his wife’s head repeatedly until it bleeds.

Duty counsel Lim Ming Zoong @ Lawrence representing Andy, requested a lower fine on the grounds that he had been remanded for four days and married with a child and was the breadwinner of his family.
The court ordered Andy to serve the jail sentence from the date of his arrest on June 18.
Andy was charged under Section 323 of the Penal Code read together with Section 326A of the same Code.
Section 323 carries a jail term of up to one year or a fine of up to RM2,000 or both, on conviction while Section 326A states that whoever causes hurt to his spouse or former spouse, a child, a disabled adult, or other family members and commits an offence under Section 323, 324, 325, 326, 334 or 335 shall be punished with imprisonment for a term of twice as long as the maximum term for which he would be liable to on conviction for that offence.
In another case, a 78-year-old man was fined RM1,000 or a month’s jail for fighting in a public place, two years ago.
Thomas Tham admitted to committing affray at 8.50am on May 22, 2021 at a restaurant in Taman Cantik.
He was jointly charged with another accused Daniel Liew, who pleaded not guilty to the charge and was offered bail at RM1,000 in two sureties pending pre-trial case management on July 24.
The charge under Section 160 of the Penal Code carries a jail term of up to six months or fine of up to RM1,000 or both on conviction.
Based on the facts presented by the prosecution, a heated argument ensued between Tham and the other man over a business matter which led to a fight between them.
Counsel Luqman Syazwan Zabidi Mohd, representing Tham, requested a lower sentence on the grounds that he was a senior citizen, first offender and was remorseful. Inspector Navind Kumar Vijayan prosecuted.
