Kota Kinabalu: A 38-year-old bodyguard was on Wednesday fined RM1,500 or two months jail for assaulting a man last year.
Muhd Rafley Karim pleaded guilty before Magistrate Stephanie Sherron Abbie to voluntarily causing hurt to AK Abd Izzat AK Abd Mutalip, 27, at 12.20pm on Dec 13, 2023 at the fire elevator, next to a kitchen of a restaurant, at Block B of Wisma Muis.
Rafley committed the offence, along with an accomplice still at large, which caused the complainant to suffer injuries on his mouth, head, left hand and body.
Inspector Suzie SK informed the court that AK Abd Izzat was waiting for the lift when Rafley approached him and accused him of harassing his fiancée.

Counsel Sylyester Kuan, representing Rafley, requested for a lower fine on the grounds that Rafley was remorseful and promised would not repeat the offence.
Sylvester informed the court that Rafley’s fiancée claimed she was harassed by her colleague (AK Abd Izzat), adding that Rafley got married on Dec 23 last year.
The counsel added that Rafley was the sole breadwinner of his family and had been cooperative with the police during investigations.
Rafley was charged under Section 323 of the Penal Code which carries a jail term of up to one year or fine of up to RM2,000 or both, on conviction.
In another case, a salesman was fined RM1,000 or a month’s jail for having gambling paraphernalia.

The offence under Section 9 (1) of the Common Gaming House Act provides for a fine of up to RM5,000 or up to six months jail or both, on conviction.
Duty counsel Carmen Khoo, representing Wong, applied a lower fine as he was married with a child, unemployed, remorseful and taking care of his elderly mother.
The court ordered the seized money to be forfeited as government revenue.
