Kota Kinabalu: A 39-year-old self-employed was charged with giving a RM650 bribe to a policeman so that no action would be taken against him for not having a driving licence and releasing an illegal immigrant.

Ghani Ahmad pleaded not guilty before Sessions Court Judge Jason Juga to the charge against him on Tuesday.

Ghani is accused of giving the bribe to ASP Daniel Dominic who is attached at the Traffic Investigation and Enforcement Division, as an inducement to not take action against him for driving without a licence and also releasing one Malali Juani who did not have any identification document.

He allegedly committed the offence at 7.45am on June 19, 2022 at the Yayasan Sabah roundabout, near here.

The offence under Section 17(b) of the Malaysian Anti-Corruption Commission (MACC) Act 2009 and punishable under Section 24(1) of the same Act which provides for a jail term of up to 20 years and a fine of up to five times the value involved, or RM10,000, whichever is higher, if found guilty.

The court released Ghani on bail of RM10,000 with RM2,000 deposited in a local surety as well as to report to MACC’s office here once in two months.

Ghani was also reminded to not harass any prosecution witnesses and if he fails to do so, his bail would be revoked.

The court set April 19 this year for pre-trial case management.

MACC Prosecuting Officer Norsham Saharom appeared for the prosecution while Ghani was not represented.
