
Kota Kinabalu: Two brothers were jailed for seven days on Thursday for assaulting a policeman who wanted to break up a fight between them.
Valley Saitim, 37, and Boby Justin Saitim, 30, both labourers, pleaded guilty before Magistrate Stephanie Sherron Abbie to using criminal force against Constable Muhd Farhan Hame Azizon by punching him with the intention of preventing him from carrying out his duties.
The duo committed the offence at 10pm, on April 16, at the five-foot-way next to Restoran Taufik, Plaza Inanam.
The charge, under Section 353 of the Penal Code, provides for a maximum jail term of two years, a fine or both, on conviction.

When the complainant arrived at the scene, he saw two men fighting tried break up the fight.
However, the two men, later identified as Valley and Boby, ignored the policeman’s attempt and even attacked him.
The complainant suffered a wound under his right eye as a result of being punched.
When asked by the court why they were fighting, the brothers replied that they were from a whiskey drinking session at Manggatal and that the younger brother was trying to break up an argument between the older brother and his wife over her refusal to make formula milk for their toddler.
Boby said it ended up with him fighting with his older brother instead.
The duo were ordered to serve the sentence from the date of their arrest.
In another case, a 41-year-old man was fined RM2,000 or three months jail for engaging in gambling sessions during the Qatar 2022 World Cup, last year.
Aldino Idris pleaded guilty before Magistrate Lovely Natasha to committing the offence at 11pm on Dec 2, 2022, at the five-foot-way of D’Selera Restaurant at Likas Plaza, Likas.
The charge under Section 7(2) of the Common Gaming House Act provides for a fine of up to RM5,000 or jail term of up to six months or both, on conviction.
Inspector Kelvan Elson Maik prosecuting, informed the court that a police team during Ops Soga (World Cup Qatar 2022) arrested a man, later identified as Aldino, for being a bookie’s agent.
The police also found the match schedules in Aldino’s WhatsApp and also seized RM124 cash from him, the court heard.
Unrepresented, Aldino requested leniency while the prosecution applied for an adequate sentence.
The court ordered the seized money to be forfeited as government revenue.
