
Kota Kinabalu: A 34-year-old woman was on Thursday jailed four months and fined RM1,800 or another two months by the Magistrate’s Court here for assaulting a woman, last year.
Clarissa P Esack, unemployed, pleaded guilty before Magistrate Stephanie Sherron Abbie to voluntarily causing hurt to her partner Aelizsandra Lynn Joannes, 23, at 7pm on Dec 6, 2022 at a house in Kg Putatan Baru.
Inspector Suzie @ Stephanie Kupit in tendering the facts of the case, told the court that on the said day, a fight ensued between the victim and her partner, Clarissa, because of jealousy.
Clarissa strangled Aelizsandra’s neck and punched her in the face, causing the victim to suffer severe injuries to her eyes and scratches on her neck, the court heard.
Clarissa was arrested by police following a report lodged by the complainant. Clarissa confessed to hitting the victim.
The offence under Section 323 of the Penal Code carries a jail term of up to one year or fine or both, on conviction.
Duty counsel Carmen Khoo requested for only a fine and said that Clarissa was remorseful.
The prosecution applied for an adequate sentence.
Clarissa was also charged with taking drugs under Section 15(1) of the Dangerous Drugs Act.
However, no plea was recorded from her pending the availability of the chemist’s report. The court set May 11 for e-review of the chemist’s report and offered no bail to her as she was already convicted of an assault offence.
In another case, a 32-year-old man was charged with violating a police supervision order under Section 15(3) of the Crime Prevention Act 1959, last year.
Jobless Pang Yau Fui pleaded not guilty to committing the offence at 7.27pm on Aug 17, 2022 at the Shang Hai Yian coffeeshop in Penampang.
The charge stated that Pang allegedly violated the conditions of the order, which required him to be at home in the area where he was restricted from 8pm until 6am, unless he gets the permission from the Penampang district police chief.
The charge under Section 15(4) of the Crime Prevention Act 1959 carries a jail term of between two years and 10 years, on conviction. The prosecution in applying for another mention date, proposed bail at RM6,000 in two sureties.
Counsel Luke Ressa Balang, representing Pang, applied for a lower bail.
The court set May 15 for case management and released Pang on a bail of RM2,500 in two sureties.
