
Kota Kinabalu: A 32-year-old part time driver was tentatively charged in the Magistrate’s Court here on Wednesday with trafficking 11,383grammes of Ketamine.
However, no plea was recorded from Mohd Faizol Abu Karim, who appeared before Magistrate Dzul Elmy Yunus, after the charge was read out to him.
Faizol was accused of trafficking the drugs at 1.07am on Aug 6, this year, at the Domestic Arrival Hall of the Kota Kinabalu International Airport here.
The charge under Section 39B(1)(a) of the Dangerous Drugs Act (DDA) 1952, carries a punishment of either the death penalty or life imprisonment and whipping with a minimum of 15 strokes.
The court fixed Oct 16 for mention pending the chemist’s report.
Faizol was ordered to be remanded further pending the date, as the charge against him has no provision for bail.
Customs Department Prosecuting Officer Said Hamid Said Idrus prosecuted.
The accused was not represented.
In another case, a 40-year-old man was freed from a charge of having stolen copper cables.
Magistrate Dzul discharged and acquitted Abd Zaidi Abdul Rahman of the charge after allowing the prosecution’s application for his discharge and acquittal, and ordered the return of his vehicle along with a refund of his bail.
The hearing on Wednesday was held to update the court on a representation letter submitted by Zaidi’s counsel to the Deputy Public Prosecutor’s office, with counsel Jagnesh Jaya, representing Zaidi, confirming that the prosecution had consented to the discharge and acquittal.
Zaidi was accused of having 80 metres long of the stolen cable belonging to Telekom Malaysia at 2.40pm on Feb 11, this year, at Tanjung Aru, a charge under Section 411 of the Penal Code.
