
Clare Rewcastle-Brown, the editor of Sarawak Report, received a two-year jail sentence from a Magistrates’ Court for criminally defaming Sultanah Nur Zahirah of Terengganu. Datuk Shanmugam Ganesan, a senior lawyer, stated that upon entering Malaysia, Rewcastle-Brown could face arrest due to the criminal charge against her. He advised her to refrain from visiting Malaysia until her legal matters are resolved and recommended filing a stay of execution to postpone her sentence temporarily.
Rewcastle-Brown, who faced charges under Section 500 of the Penal Code for defamatory remarks in her book, The Sarawak Report: The Inside Story of the 1MDB Exposé, was absent during her trial. Datuk Geethan Ram Vincent, another senior lawyer, highlighted her potential legal options, including appealing against her conviction and sentence, citing procedural irregularities and legal errors.
Moreover, Rewcastle-Brown could seek revision to address any legal irregularities or errors in judgment during her trial. Datuk Sheelan Arjunan, another senior lawyer, emphasized various grounds for challenging her conviction and sentence, such as procedural irregularities, legal errors, and ineffective assistance of counsel.
Despite constitutional guarantees of freedom of speech, assembly, and association, lawyers emphasized that these rights must not infringe upon sensitive issues like race, religion, and the royal institution. Sultanah Nur Zahirah sued Rewcastle-Brown for criminal defamation over claims in her book, alleging corrupt practices and interference in state affairs.
On February 8, Rewcastle-Brown filed a notice of appeal at the High Court in Kuala Terengganu, seeking to overturn her criminal defamation conviction and sentence. She requested the court to review the sentence under relevant legal provisions and to waive her presence during the appeal hearing.
