
Kota Kinabalu: A 52-year-old self-employed was charged with committing physical sexual harassment against his daughter.
The man pleaded not guilty before Sessions Court Judge Noor Hafizah Mohd Salim to the charge against him on Wednesday.
The man is accused of committing the offence against his 12-year-old girl by fondling and licking her breasts at 3.30pm on Oct 3 this year at a room of a house in Kepayan, near here.
The offence, under Section 14 (a) of Sexual Offences Against Children Act 2017, carries a jail term of up to 20 years, and whipping on conviction.
Due to his relation between the alleged victim, there will be additional punishment under Section 16(2)(c) of the same Act that carries a jail term of up to five years, and whipping at least two strokes, on conviction.
The court set Nov 17 this year for e-review and ordered the man to be remanded further pending the date.
Deputy Public Prosecutor (DPP) Dacia Jane Romanus appeared for the prosecution while the man was not represented.
Meanwhile, a 33-year-old man was jailed seven years and ordered to be given 10 strokes of the cane for having 32.14gm of syabu.
Mohd Fauzi Roslim pleaded guilty before Sessions Court Judge Elsie Primus, to the charge against him.
He was found having the drugs at 4.35pm on Dec 17, 2020 in front of car service centre in Sulaman Sentral Kuala Manggatal, here.
The court ordered Mohd Fauzi to serve the jail sentence from the date of his arrest on Dec 17, 2020 and the vehicle which was seized during the arrest, to be returned to the original owner.
During mitigation, Mohd Fauzi who was not represented asked for leniency saying that it was his first offence and that he has to look after his seven-year-old son.
He also told the court that he was infected by Covid virus three times.
However, DPP Tham Pou Jin urged the court to impose a deterrent sentence so as to give a lesson not only to Mohd Fauzi but other would-be offenders.
