Kota Kinabalu: Two restaurant kitchen workers were slapped with a fine of RM25 or a day’s jail on Wednesday for behaving in a way that disturbed public order and their colleague.

Alih Ismail, 30, and Halim Ismail, 25, pleaded guilty before Magistrate Stephanie Sherron Abbie to committing the offence against Arbin Jul Asmad at 9pm on Aug 6 at Sasa Seafood Restaurant, Taman Suria in Penampang.

The offence under Section 8(1)(e) of the Minor Offences Ordinance provides a fine of RM25 on conviction.

The court was informed by the prosecution that prior to the incident, the complainant was breaking up a fight between two of his colleagues when suddenly he was punched by several men including Alih. The complainant suffered a bruise on the right eye due to the actions of the group of men.

Meanwhile, a lorry driver was charged with disposing of stolen copper pieces weighing 13.5kg.

Harry Sitiu, 31, pleaded not guilty to committing the offence on the copper belonging to Ooi Eng Keat between 12pm and 6.30pm on Aug 29 at GS Trading, Bantayan, Inanam.

The offence under Section 414 of the Penal Code carries a jail term of up to seven years or fine or both, on conviction.

The court set Sept 25 for pre-trial case management and released the accused on a bail of RM1,800 in two sureties.
