Duo jailed for careless driving

Kota Kinabalu: Two individuals were sentenced by the Traffic Court here Tuesday for careless and inconsiderate driving which resulted in an accident.

Iffah Syazwani Asri, 31, and Sylvestor Indeck, 57, pleaded guilty separately before Magistrate Stephanie Sherron Abbie to the charge framed against them, respectively.

Iffah was ordered to pay a fine of RM5,000 or three months jail for committing the offence at 7pm on Aug 6, 2022 at the U-turn Kg Dumpil, Jalan Papar–Kota Kinabalu, Putatan.

The charge stated that Iffah while driving a car had made a “U” turn without due care and attention and was hit by a motorcyclist riding on a straight road.

Read more The court heard from the prosecution that the motorcyclist suffered serious injuries, namely a fractured right femur, left wrist, left elbow and brain haemorrhage.

Meanwhile, Sylvestor, who committed the offence at Jalan Sugud, near Kg Penapah Kondis, Penampang at 5.45am on March 26, 2023, was sentenced to Compulsory Attendance Order (PKW) for three months.

He was ordered to undergo the order for four hours daily.

The charge stated that Sylvestor committed the offence while driving a car.

Iffah and Sylvestor were charged under Section 43(1) of the Road Transport Act 1987 (Amended 1999) which carries a fine of between RM5,000 and RM10,000 and liable to jail of up to 12 months, on conviction.

Deputy Public Prosecutor Batrisyia Mohd Khusri and Traffic Prosecuting Officer Inspector Mohd Firdaus Che Mustafa prosecuted.

Iffah and Sylvestor were represented by counsel Farah Nazriah Chun Lee and a counsel, respectively.
