Federal must act on 40pc: PBS

Kota Kinabalu: Parti Bersatu Sabah (PBS) wholeheartedly embraces and champions the monumental High Court decision, which supports the Sabah Law Society (SLS) regarding Sabah’s 40pc entitlement under Articles 112C and 112D of the Federal Constitution.

The ruling emphatically reaffirms the Federal Government’s constitutional and moral duty to honour the terms agreed upon in the Malaysia Agreement 1963 (MA63) and the fundamental principles of our Federation.

PBS Acting President Datuk Seri Panglima Dr. Joachim Gunsalam conveyed the party’s profound appreciation and congratulations to the Sabah Law Society (SLS) for their unwavering dedication and fortitude in pursuing this judicial review.

“PBS salutes SLS for resolutely standing up for all Sabahans. This decision is not merely a triumph for the rule of law but also for the very essence of fairness, equality, and the spirit of partnership enshrined within MA63,” he stated.

Joachim emphasized that this judgment validates what Sabahans have long maintained – that the 40pc entitlement is not a mere privilege but an inalienable constitutional right guaranteed to Sabah.

“For almost five decades, this right has been regrettably overlooked and deferred. The moment has arrived to rectify this historical oversight and to fully implement the constitutional promises made to the people of Sabah,” he asserted.

PBS urgently calls upon the Federal Government to fully comply with the Court’s directives, initiating a comprehensive review within 90 days and reaching a definitive agreement with the Sabah Government within 180 days regarding the revenue owed for the period from 1974 to 2021.

“The Court’s order must be honored without any further delays or justifications. Justice delayed is unequivocally justice denied,” Dr. Joachim added.

He further underscored that this issue transcends partisan politics and should galvanize all Sabah leaders to unite in safeguarding the state’s constitutional and fiscal rights.

“PBS has consistently been at the forefront, advocating for the restoration of Sabah’s rights under MA63. This judgment marks a pivotal advancement in re-establishing equilibrium within our Federation,” he affirmed.

In conclusion, PBS reiterates its unwavering support for the Sabah Law Society and the judiciary for their steadfast commitment to upholding the rule of law and protecting Sabah’s rightful position within Malaysia.

“Let this landmark decision herald a new epoch of sincerity and fairness in the relationship between Sabah and the Federal Government. After 48 years, it is imperative that we honor our agreements and uphold the sanctity of the Constitution,” Joachim declared.
