Kota Kinabalu: A 54-year-old food vendor was charged in the Magistrate’s Court here Friday with two counts of cheating a man of RM5,500 over the sale of a vehicle.
Jackson Koh Kok Fah, who appeared before Magistrates Stephanie Sherron Abbie and Lovely Natasha Charles, pleaded not guilty to both charges.
On the first count, Koh allegedly cheated Yohanes Sanih by making him believe that he (Koh) has a 4x4 Isuzu vehicle for sale, causing Yohanes to hand over RM2,000 to him.
The offence was allegedly committed in a restaurant in Donggongon on Dec 11, 2018.
On the second count, Koh was accused of cheating Yohanes of RM3,500 over the same matter between Dec 21, 2018 and Jan 4, 2019 at Maybank in Tawau.
Each charge under Section 420 of the Penal Code carries a jail term of between one year and 10 years and with whipping and liability to a fine, on conviction.
The court fixed Dec 8 for case management on each charge and released Koh on a bail of RM1,500 in one surety on each charge.
Earlier, counsel Sylyester Kuan, representing Koh, applied for a lower bail sum because Koh, who is married with five children, was the sole breadwinner of his family and had no fixed income as a food vendor.
In another case, a 21-year-old man was fined RM100 or a day’s jail for trespassing into a property in the city.
Al-Subhi Yusop admitted before Magistrate Stephanie to committing the offence at the Sutera Harbour Resort golf course area at 9.30am on Nov 7, this year.
According to the prosecution, Al-Subhi was believed to have entered the area through a barbed wire fence near the large ditch facing Imago Mall.
Al-Subhi’s claim of wanting to return to his home in Kg Tanjung Aru Lama through a shortcut.
He was charged under Section 17(1) of the Minor Offence Ordinances which provides a fine of RM100, on conviction.
