
Kota Kinabalu: A 22-year-old undocumented man was jailed eight months by the Magistrate’s Court for having a stolen motorcycle.
Mohd Sadik Salleh pleaded guilty before Magistrate Marilyn Kelvin to keeping a stolen WMoto F-15l motorcycle belonging to Jailie Asimin on March 16, this year, at 5.50pm, at an open land in Kg Numbak Alamesra.
The facts of the case presented by the prosecution stated that Jailie, who had just regained consciousness after a night of heavy drinking at a nearby nightclub, found his motorcycle stolen at the parking lot in Inanam Taipan, on March 6, the same year.
Sadik was charged under Section 411 of the Penal Code which carries a jail term of between six months and five years and liable to a fine, on conviction.
The court ordered Sadik to serve the sentence from the date of his arrest and referred to the Immigration Department, thereafter.
In another case, a woman was fined RM1,300 or jailed one month for engaging in online gambling in public.
Armelynn Abubo admitted to committing the offence using a handphone on Jan 2, this year, at 5.30pm at the five-foot-way of a shop in Manggatal town.
The charge under Section 7(2) of the Common Gaming Houses Act 1953 provides for a fine of up to RM5,000 or up to six months’ jail or both, on conviction.
According to the facts of the case presented by the prosecution, a police team, who found illegal gambling activity in the area, raided the place and arrested Armelynn and seized the gambling paraphernalia from her, including RM100 in cash.
An analysis report found that the seized paraphernalia was confirmed linked to gambling activity under the Common Gaming Houses Act.
The court ordered the seized money to be forfeited to the government.
