Indonesian man jailed 19 months for hurting, threatening beau

TAWAU: An Indonesian man was sentenced to a total of 19 months’ jail by two Magistrates’ Courts here on Monday after pleading guilty to hurting his 18-year-old girlfriend and threatening to kill her during an argument over allegations that he was seeing another woman.

Mohd Jumain Baharuddin, 25, was sentenced to seven months’ imprisonment by Magistrate Dayang Aidaku Amira Aminuddin after pleading guilty to voluntarily causing hurt to his girlfriend.

The sentence was ordered to take effect from the date of his arrest.

He had earlier been sentenced to 12 months’ jail by Magistrate Don Stiwin Malanjum for criminally intimidating the same victim by telling her, “I will deal with you and kill you.”The court also ordered him to be referred to the Malaysian Immigration Department (JIM) upon completing his sentence.

Both offences were committed in a rented room along Jalan Habib Sheikh at about 3pm on Oct 5, 2026.

The charge of voluntarily causing hurt was brought under Section 323 of the Penal Code, which carries a maximum jail term of one year, a fine of up to RM2,000, or both, upon conviction.

The criminal intimidation charge, under Section 506 of the same code, carries a maximum jail term of seven years, a fine, or both, upon conviction.

According to the facts of the case, Mohd Jumain and the victim were in a relationship, and the incident occurred during an argument believed to have stemmed from her accusation that he was seeing another woman.

He allegedly used his right hand to hit her on the neck, shoulder, back and left ribs.

The victim lodged a police report on Oct 12 and sought treatment at Tawau Hospital.

Mohd Jumain was arrested at about 7.30pm the same day at the walkway of a shoplot building in Sabindo, Jalan Edwin Chan.

Investigations found that he was an Indonesian national who had come to Sabah to seek employment and had never possessed valid personal documents to reside in the State.

ASP Jeffrey Kadison and ASP Nur Intan Jamrin conducted the prosecutions in the respective cases.
