Kota Kinabalu: An Indonesian was jailed 10 months and given a stroke of cane for entering the state illegally and re-entering without document.

Sessions Court Judge Hurman Hussain handed the sentence to Ricky Yusup who pleaded guilty to the two charges against him.

Ricky was arrested by Immigration Department personnel in Kota Marudu, at 1.35pm on Feb 11, this year.

On the first count, he was jailed four months for entering the state illegally.

On the second count, he received six months jail and one stroke of cane for re-entering Sabah illegally after being expelled from the state on Nov 12, 2024.

The offence under Section 36 Immigration Act 1959/63 provides for a jail term up to five years, or a fine of up to RM10,000, and whipping, on conviction.

In mitigation, he asked for leniency and deportation to his hometown as soon as possible.

The court ordered Ricky to serve the jail sentence from the date of his arrest and referred to the Immigration, thereafter.

Prosecuting Officer Gresssia Yolanda Ismail Uvaraj from the Immigration appeared for the prosecution.
