
Kota Kinabalu: An unemployed man was sent to prison for 12 months on Thursday for having an imitation pistol.
Jaccqres Kadau, 50, who appeared before Magistrate Stephanie Sherron Abbie during pre-trial case management of his case, informed the court that he wished to change his plea to guilty.
Jaccqres pleaded guilty to having the imitation pistol at 1.30am on Feb 8, this year at the 7-Eleven convenience store at Damai Plaza.
He had on Feb 17, this year claimed trial to the charge under Section 36(1) of the Arms Act 1960 which carries a jail term of up to a year or a fine of up to RM5,000 or both, on conviction.
The prosecution told the court that a police team stopped a car driven by a man in a suspicious manner, later identified as Jaccqres and found the imitation pistol in the boot of the car.
Jaccqres was ordered to serve the sentence from the date of his arrest on Feb 8.
Meanwhile, a delivery man was fined RM2,000 or three days in jail for obstructing an enforcement personnel from discharging his duty.
Mohd Yusri Raimin pleaded guilty before Magistrate Jessica Ombou Kakayun to committing the offence against a Road Transport Department personnel during a roadblock at Jalan Tuaran, Inanam at 10.23am on Feb 25 this year.
The prosecution informed the court that prior to the incident, Yusri, who was riding a motorcycle was stopped by the personnel and was found to have no driving licence and no insurance coverage.
It was also found that there was three summons issued against Yusri and when the personnel issued him a summons to sign, Yusri refused to do so but later obliged.
However, Yusri did not sign the document but wrote offensive words on it causing him to be arrested.
He was charged under Section 186 of the Penal Code which carries a jail term of up to two years or a fine or both on conviction.
Unrepresented, Yusri requested leniency saying that he is married and had a sick son who needs his care and that he was remorseful for his action and promised not to commit a similar offence in the future.
In another case, a car workshop worker was also ordered to pay a RM2,000 fine or three months in jail for disposing of a stolen item.
Muhd Najib Matdaud, whose case came up for pre-trial case management, informed the court that he wished to change his plea and plead guilty.
He admitted to hiding a safe belonging to Diriwan 88 Company at 3pm on Jan 25, this year in the roadside bushes in Bongawan, Papar.
The court heard from the prosecution that the safe was reported missing from the premises at Taman Indah Permai, Sepanggar which was broken into on Dec 15 last year.
Najib was arrested by police on Jan 1, this year following the arrest of his friend, who committed the burglary.
Unrepresented, Najib requested a lenient sentence as he has three children and claimed that a friend, who came to his workplace, had asked him to throw away the thing.
He was charged under Section 414 of the Penal Code which carries a jail term of between six months and seven years and liability of a fine, on conviction.
