
Kota Kinabalu: An unemployed man, currently serving a sentence for assaulting his sister, was jailed 10 months by the Magistrate’s Court here for threatening to kill the sister during a quarrel at their family home.
Insun Habbil, 33, pleaded guilty before Magistrate Dzul Elmy Yunus to committing criminal intimidation against his younger sister, Ailinah Habbil, at Kg Padas Baru, Manggatal, at 8.30am on July 6.
The charge is under Section 506 of the Penal Code, which provides for a sentence of up to seven years in jail, a fine, or both if convicted.
The court was informed by the prosecution that Ailinah had just come out of the bathroom when Insun began scolding her.
When she confronted him, Insun kicked her twice in the stomach before threatening her by saying, “Saya kasi bunuh kau” (I will kill you).
Their father and Ailinah’s husband intervened and tied Insun’s hands and feet with a rope to restrain him. Ailinah later lodged a police report.
Police arrested Insun at the house while he was still tied up. He later tested positive for drugs during a urine test.
Unrepresented, Insun requested a lenient sentence while the prosecution applied a deterrent sentence.
Magistrate Dzul ordered Insun to serve the sentence concurrently with his present jail term for the offence of voluntarily causing hurt under Section 323 of the Penal Code.
On Aug 26, Insun was sentenced to 10 months’ jail by the Magistrate’s Court for injuring his younger sister.
In another case, a 52-year-old man was sentenced to 12 weeks’ jail for trespassing into a woman’s home.
Mussid Ammat pleaded guilty to committing the offence at Taman Milek, Jalan Penampang, at 5am on Sept 8.
The court heard from the prosecution that Mussid entered the complainant’s compound by climbing over a neighbour’s fence.
Dressed in blue and black and carrying a pair of garden shears, he was seen searching the kitchen area.
The act was witnessed by a neighbour who alerted the homeowner, Eva Lo.
Police later found Mussid asleep in the neighbour’s house and arrested him.
CCTV footage confirmed his presence, though no damage or loss was reported.
Mussid was charged under Section 448 of the Penal Code, which provides for up to three years’ jail, a fine of up to RM5,000, or both on conviction.
He requested a lenient sentence.
